Official immunity prevents personal injury lawyer from suing Dallas over fire truck incident

The Fifth District Court of Appeals in Dallas, Texas ruled on Thursday, January 16 that Texas personal injury lawyer Brian Loncar may not sue the city over a fire truck accident, as the city has official immunity.

Loncar filed a lawsuit in September 2009 pursuing damages from the city after suffering serious physical injuries in May 2008 when a fire engine, driven at that time by fireman Paul Ferguson, ran a red light resulting in a collision, causing major damage to Loncar’s Bentley.

According to the judges, Loncar was not able to present evidence that Ferguson’s statements were “riddled with inconsistencies” or that Ferguson displayed a particularly negligent character since Loncar himself admitted that Ferguson slowed when he saw Loncar’s vehicle approaching.
