Judge rules lawsuit against Trinity Industries valid

United States Judge Rebecca Smith of Virginia denied a motion made by Dallas, Texas-based rail transport company Trinity Industries Inc. to throw away a lawsuit filed by Jose and Victoria Evans in which the company is accused of intentionally hiding changes made to the guardrail that posed a threat to drivers. The pair was involved in an accident in 2011 during which the guardrail head, a feature that is supposed to absorb impact, failed to operate correctly and punctured their vehicle, causing serious injuries to both individuals.

Trinity’s motion was denied on Tuesday, September 29. Judge Smith ruled that the plaintiffs’ accusations were valid and that the statute of limitations had not yet run out as the couple could not have known of the company’s fraudulent concealment within the two-year limit.

Honda Issues Vehicle Recalls over Rollaway Fears

Honda has issued a recall for a number of vehicles because of a potential ignition interlock problem that could lead to a vehicle rolling away, resulting in a collision. The affected models include Honda Odyssey minivans and Pilots from the 2003 and 2004 model years, and Acura MDX SUVs from the 2003-2006 model years.

According to an estimate from the National Highway Traffic Safety Administration, the number of affected vehicles could be as high as 807,161. The problem stems from a change made to the vehicle’s ignition interlock system that could allow a driver to remove the key to the vehicle without the vehicle being in park, which could allow the vehicle to roll away.

If you or someone you know has been injured in an auto accident caused by this problem or any other vehicle defect, you should not be forced to shoulder the burden of this accident on your own.
