Judge rules lawsuit against Trinity Industries valid

United States Judge Rebecca Smith of Virginia denied a motion made by Dallas, Texas-based rail transport company Trinity Industries Inc. to throw away a lawsuit filed by Jose and Victoria Evans in which the company is accused of intentionally hiding changes made to the guardrail that posed a threat to drivers. The pair was involved in an accident in 2011 during which the guardrail head, a feature that is supposed to absorb impact, failed to operate correctly and punctured their vehicle, causing serious injuries to both individuals.

Trinity’s motion was denied on Tuesday, September 29. Judge Smith ruled that the plaintiffs’ accusations were valid and that the statute of limitations had not yet run out as the couple could not have known of the company’s fraudulent concealment within the two-year limit.
